ERGO® BEDDING WARRANTY

WARRANTY COVERAGE

The warranty coverage relates to certain quality defects with respect to the mattress protector within the first 2years, 5years, 7year or 10years following purchase, as per the warranty period stipulated on the packaging of the product you purchased. See exceptions below. In order to qualify for full warranty protection, all damages must be reported to Ergo® Bedding within (5) days of occurrence. In addition, the product must be purchased new, in its original packaging and from an authorized dealer.

 

WHAT IS NOT COVERED

Warranty coverage does not extend to any or all of the following: (a) misuse/abuse; (b) failure to follow care instructions; (c) normal wear and tear including rips, tears, and loose threads: (d) stains and/or damage caused by grease, corrosives, and/or dyes/solvents; (e) more than 16 fluid ounces; (f) burns, fires, flood, theft, vandalism or any other loss incurred that is covered under an insurance policy;(g) mattress protector that is not fitted correctly to the mattress size, (h) mattresses used for commercial, institutional or rental purposes (i) flood or fire damage; (j) improper installation of the mattress protector; or (k) mattress protectors/mattresses located on patios, screened rooms, or outdoors which may be exposed to the elements. All fabrics are subject to general soiling and this warranty does not eliminate the need for routine care and washing of the mattress protector. General soiling is defined as gradual build-up of dirt, dust, body oils and perspiration, which cannot be attributed to a single occurrence.

 

HOW ERGO® BEDDING CAN HELP

Ergo® Bedding at its sole discretion, will: (1) in the case of the claim for a mattress protector, replace a protector that has been proven to be defective in materials or workmanship, and that falls within the warranty guidelines; (2) in the case of a claim for mattress staining, Ergo® Bedding will provide a cleaning solution, or have the mattress professionally cleaned/sanitized, provided the claim falls within the warranty guidelines stipulated above. Cleaning of the mattress or mattress protector is limited to one (1) mattress or mattress protector during the life of the warranty. Cleaning of the mattress or cleaning or replacing the mattress protector fulfills all terms and conditions of the warranty.

 

To the extent permissible by applicable law, the mattress protector is provided “as is” and this warranty is your exclusive warranty and replaces all other warranties or conditions, express or implied, other than such implied warranties which cannot be waived in certain jurisdictions. Some states or provinces do not allow limitations on how long an implied warranty lasts, so the above limitation may nonapple to you. Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may also have other rights that vary from state to state, province to province and jurisdiction to jurisdiction. To the maximum extent permitted by applicable law and except as set forth in this limited warranty, in no event will Ergo® Bedding  or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the mattress or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if Ergo® Bedding has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. Ergo® Bedding total liability will not exceed the purchase price paid for the mattress protector giving rise to such liability. Some states or provinces donot allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you.

 

HOW TO CLAIM

Email warranty@ergobedding.com to submit a warranty claim. You will need to provide proof of purchase, such as a receipt or invoice, a photo of the washing label and proof of damage, in order to validate the warranty claim. As part of the claims process, the defective mattress protector must be returned to Ergo® Bedding for inspection and testing in order to qualify if deemed necessary by Ergo® Bedding. The customer shall incur all courier or transportation costs associated with this warranty. This warranty is not transferrable. Ergo® Bedding reserves the right to revise the warranty from time to time.
